Terms of Use

Please read these Terms of Use carefully before using the OASIS HUB platform. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use our platform.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and Global Charging OASIS HUB ("OASIS HUB", "we", "us") governing your access to and use of the OASIS HUB EV charging management platform, mobile applications, APIs, and related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and accept these Terms in full.

2. Description of Services

Global Charging OASIS HUB provides a cloud-based EV charging management platform that enables:

  • Charge Point Operators (CPOs): to manage EV charging infrastructure, sessions, billing, and operations
  • eMobility Service Providers (eMSPs): to manage driver accounts, roaming, and payment services
  • Fleet Operators: to manage EV fleets, charging schedules, and cost allocation
  • EV Drivers: to find chargers, start sessions, manage payments, and track charging history
  • Roaming Hubs: to facilitate OCPI-based interoperability between charging networks

3. Account Registration

To access most features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and not share it with third parties
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Charging Services and Payments

4.1 Charging Sessions

When you initiate a charging session through the Platform, you agree to pay the applicable tariff as displayed before the session starts. Tariffs are set by the Charge Point Operator and may vary by location, time, connector type, and your subscription plan.

4.2 Payment Processing

Payments are processed by our authorised payment partners (Stripe, PayPal, Apple Pay, Google Pay, MercadoPago, Cielo, Viva Wallet). By adding a payment method, you authorise us to charge the applicable fees. All payments are subject to the terms of the relevant payment processor.

4.3 Pre-Paid Wallets

If you use a pre-paid wallet, funds added to your wallet are non-refundable except as required by applicable law. Wallet balances do not expire while your account is active.

4.4 Refunds and Disputes

If you believe you have been incorrectly charged, please contact us within 30 days of the charge. We will investigate and, if the charge was in error, issue a refund or credit to your account within 14 business days.

5. Subscriptions

If you subscribe to a paid plan:

  • Subscriptions renew automatically at the end of each billing period unless cancelled
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • We reserve the right to change subscription prices with 30 days notice; continued use after the notice period constitutes acceptance of the new price
  • No refunds are provided for partial subscription periods, except as required by applicable consumer protection law

6. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law, regulation, or third-party rights
  • Engage in fraudulent transactions or payment fraud
  • Attempt to gain unauthorised access to any part of the Platform or other users' accounts
  • Interfere with or disrupt the Platform's infrastructure or security
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use automated tools (bots, scrapers) to access the Platform without our written permission
  • Transmit malware, viruses, or any malicious code
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

7. API Usage

If you access the Platform via our API:

  • You must keep your API credentials confidential and not share them with third parties
  • You are responsible for all API calls made using your credentials
  • We may impose rate limits on API usage to ensure platform stability
  • We reserve the right to revoke API access if usage violates these Terms or causes harm to the Platform

8. Intellectual Property

The Platform, including all software, content, trademarks, and intellectual property, is owned by OASIS HUB or its licensors. These Terms do not grant you any ownership rights in the Platform.

You retain ownership of any data you submit to the Platform (your charging data, driver profiles, etc.). By submitting data, you grant us a limited licence to use that data to provide the Platform services as described in our Privacy Policy.

9. Availability and Service Levels

We strive to maintain high availability of the Platform but do not guarantee uninterrupted service. We may perform scheduled maintenance (with advance notice) or emergency maintenance as required.

For enterprise customers with Service Level Agreements (SLAs), the terms of the SLA govern availability commitments and remedies for downtime.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • OASIS HUB is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
  • Our total liability for any claim arising from these Terms or your use of the Platform is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for the actions of Charge Point Operators, including charger availability, pricing, or service quality
  • We are not liable for failures caused by third-party payment processors, network outages, or force majeure events

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless OASIS HUB, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to use the Platform ceases. We will retain your data as described in our Privacy Policy and as required by law.

13. Governing Law and Disputes

These Terms are governed by the laws of Portugal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal, unless mandatory consumer protection laws in your country of residence require otherwise.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
